Miami, FL – Bilzin Sumberg is pleased to announce that it's victory, on behalf of firm client Avnet Inc., in the Capacitors Antitrust Litigation has been recognized by legal publication Law.com in its list of Top 100 Verdicts of 2023. The Top 100 Verdicts is compiled through exhaustive research efforts by publication staff to arrive at a comprehensive list of the top 100 jury awards for a given year. The listed verdicts are ranked by gross award decided by the jury in each case.
Bilzin Sumberg’s Antitrust Team, led by Litigation and Trial Partners Robert W. Turken, Scott N. Wagner, and Lori P. Lustrin, secured an unprecedented $267 million verdict in the Capacitors trial, landing it at 20th place among the verdicts on the list. The award represents the largest jury verdict for an antitrust opt-out plaintiff in U.S. history. The victory was the culmination of a long-running antitrust case representing Avnet Inc., the second largest electronics components distributor in the country. The Antitrust Team argued that the trial defendants, and their co-conspirators, knowingly conspired to manipulate prices for capacitors sold in the U.S. and purchased by their client. In May 2023, a California federal jury unanimously found that Japanese capacitor manufacturer, Nippon Chemi-con, along with an American subsidiary, knowingly conspired to manipulate prices for aluminum and tantalum capacitors sold in the U.S. and purchased by Avnet.
The trial win reinforced Bilzin Sumberg’s long track record of impressive outcomes in high-stakes, complex actions over the last decade, including the LCD flat panel and cathode ray tube (CRT) cases. The remarkable results achieved by Bilzin Sumberg’s Antitrust Team further solidified Bilzin Sumberg as a go-to counsel for complex litigation in federal courts.
Bilzin Sumberg’s antitrust and trial attorneys are consistently recognized, both individually and collectively, for their accomplishments, thought leadership, effectiveness at crafting arguments and developing precedent, and ability to steer their clients through the complexities of litigation. The Antitrust Team is recognized across leading industry publications for its work, including occupying Chambers USA’s highest ranking of Band 1 for its Antitrust Florida section.
