Bilzin Sumberg has represented clients in a diverse array of complex financial services litigation matters. Our work has been especially noteworthy in the areas of mortgage loan repurchase and indemnification defense and residential mortgage-backed securities (RMBS) litigation. Cross-leveraging legal talent from our Real Estate and Corporate, Finance and Restructuring Groups, our Litigation Group has defended billions of dollars' worth of such claims throughout the U.S. We also handle complex litigation focused on the banking, insurance and accounting industries, and on behalf of financial services divisions of major national homebuilders, "home offices" and wealth management companies.

Our financial services litigation team has successfully litigated and resolved claims nationwide, including in California, Colorado, Florida, Minnesota, Missouri, New Jersey, New York, Pennsylvania, Tennessee, Texas, Utah, and Virginia. We have defended over 100 mortgage originators and brokers against claims brought by numerous large institutions including Freddie Mac, Fannie Mae, Bank of America, Countrywide Home Loans, CitiMortgage, Wells Fargo, Lehman Brothers Bank, Aurora Loan Services, JPMorgan Chase, RFC/ResCap, US Bank, and the FDIC. Our litigation tactics are unencumbered by conflicts of interest that may occur when firms represent both originators and big banks or GSEs.

Our multi-disciplinary team provides a unified approach to resolving high-stakes financial services litigation, representing financial institutions, loan originators, servicers, and sellers in all phases of the dispute – from pre-litigation risk management and review and investigation of pre-litigation demands through the defense of claims, whether in litigation or arbitration. Additionally, in an effort to resolve issues without involving the courts, the team is seasoned in non-litigation dispute resolutions.

We also assist financial services companies with complex commercial litigation generally, and with data privacy litigation and compliance issues. Our wealth of experience allows us to tailor and streamline our litigation, arbitration, and case resolution strategies to provide cost savings to our clients while continuing to maintain the highest standards of aggressive representation.
